Surplus Funds/Asset Recovery
Losing your property through foreclosure is a painful experience that creates a variety of hardships.  However, there can be light at the end of the tunnel.  When your property is sold at the sheriff’s sale, there may be money left over after your lender and other creditors are paid off.  Known as Surplus Funds, there is no law stating you must be informed of these funds.  Instead the surplus funds are sent to the state where it sits in an account, unknown to you.  As the former property owner, you have a right to recover those funds. 
 
Recovering your surplus funds can be daunting and is not as simple as making a phone call or writing a letter.   First, you need to know of the existence of the surplus funds and then you need to follow a very specific and detailed series of steps to recover your funds.  Failure to follow these steps with absolute precision will result in the request for the funds being denied.  We have had success recovering funds for clients who previously attempted to recover funds on their own, only to be denied.  We’ve also worked with some clients who engaged the services of attorneys who are unfamiliar with the process and were unable to succeed. 
 
We have also worked with clients who were approached by out of state companies charging fees for their services that were considered objectionable.  We provide our services on a contingent basis, meaning if for any reason we are unable to recover your surplus funds, your out of pocket cost is zero.  We only get paid if we are successful in our efforts.   Our contingency rate is reasonable and takes our client’s needs into account.
